The Puerto Vallarta Sweepstakes

1. How to Enter. Log onto www.visitpuertovallarta.com and follow the directions to enter between 12:00 AM Eastern Time (ET) on April 1, 2008 and 11:59 PM ET on November 30, 2008 You must include on the online entry form your complete name, street address (no P.O. Boxes), zip/postal code, date of birth and email address to receive one (1) entry. You may also receive one (1) additional entry for each unique friend's email address that you provide, up to a maximum of five (5) additional entries. All entrants must have a valid email address. In case of dispute as to identity of entrant, entry will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized Account Holder" is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. A potential winner may be requested to provide Sponsor (defined below) with proof that such winner is the authorized account holder of the email address associated with the winning entry. Any other attempted form of entry is prohibited; no automatic, programmed; robotic or similar means of entry are permitted. Sponsor, its affiliates, partners, promotion and advertising agencies and any entities involved with the administration or fulfillment of this Sweepstakes are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, Web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to enter the Sweepstakes, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes.
Limit six (6) entries per person/email address. All entries become the sole property of the Sponsor and receipt of entries will not be acknowledged or returned. Delivery of prizes requires a street address (no P.O. Boxes). Sponsor is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, technically corrupted or misdirected entries, which will be disqualified. Only fully completed entry forms are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.
2. Eligibility. Participation open only to legal residents of the 50 United States and the District of Columbia who are age 18 and over as of April 1, 2008 and legal residents of Canada who are over the age of majority in their province/territory of residence as of April 1, 2008. Void in anywhere outside of the United States. or Canada and where prohibited, or restricted by law. Employees, officers & directors of the Puerto Vallarta Tourism Board, Green Team Advertising and its parent companies, subsidiaries, affiliates, partners, dealers, advertising and promotion agencies, manufacturers or distributors of sweepstakes materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter. This Sweepstakes is governed exclusively by the laws of the United States and Canada. Sweepstakes may only be entered in or from the 50 United States and the District of Columbia and Canada and entries originating from any other jurisdiction are not eligible for entry.
3. Drawing. Winner will be selected in a random drawing from all eligible entries received. Odds of winning depend on the number of eligible entries received for the drawing. Drawing will be conducted by the Puerto Vallarta Tourism Board on or about December 15, 2009 at 12 p.m. (EST) in New York City, New York. If the selected entrant is a Canadian resident, he/she must correctly answer a time-limited mathematical skill-testing question to be administered by phone or mail-in order to win the prize. By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these rules and the decisions of the Sponsors, which will be final and binding in all matters relating to the Sweepstakes. Winner will be awarded one prize of their choice among three options: Gourmet Vallarta, Endless Activity or The Art of Mexico.
4. Prizes. One (1) Grand Prize will be awarded, which will consist of the winner's choice of the Gourmet Vallarta, Endless Activity or Art of Mexico package. The Gourmet Vallarta, Endless Activity and Art of Mexico packages each include a trip for two (2) to Puerto Vallarta, Mexico, consisting of round-trip economy-class air transportation from major gateway airport nearest winner's residence to Puerto Vallarta, Mexico, and five (5) days/four (4) nights hotel accommodations (single room, double occupancy) in Puerto Vallarta, Mexico. The Gourmet Vallarta package includes 4 meals in Five Star Diamond Award restaurants and all breakfasts; The Endless Activity package includes stay at an all-inclusive hotel with all meals included and canopy tour, Sierra Madre expedition, dune buggy outing and repelling tour; and The Art of Mexico package includes art gallery and Huichol art tour, San Sebastian del Oeste tour, Hacienda Doña Engracia tour (a Tequila distillery with horseback riding and mountain biking) and all breakfasts. Grand Prize includes all visits, excursions, activities, dinners mentioned in the prize option chosen by the winner as well as, ground transportation while in Mexico. Approximate retail value of any Grand Prize package $4,900 US/ $4,951 CDN (Actual retail value will depend on itinerary and departure date). Prize does not include gratuities, personal incidentals, and transportation to and from departure airport, travel upgrades or any other expenses not specifically listed herein. Travel/hotel accommodations (double occupancy) and transportation arrangements are at the sole discretion of the Sponsors. Travel and accommodations subject to availability, certain restrictions and blackout dates may apply. Airline carrier and hotel regulations and conditions apply. Winner and travel companion must obtain proper passports or other travel documentation and must depart and return between April 1st, 2009 and November 30th, 2009 or prize will be forfeited and awarded to an alternate winner in a random drawing from all remaining eligible entries.
All travel and accommodations are at winner's and travel companion's risk. All travel companions that are minors must be accompanied by his/her parent or legal guardian on the trip.
5. Notification. Winner will be notified by email and will be required to sign and return, where legal, an Affidavit/Declaration of Eligibility and Liability/Publicity Release within seven (7) days of prize notification. Travel companion will also be required to sign and return a Liability/Publicity Release, where legal, prior to issuance of prize elements. If winner/travel companion is a minor, Affidavit/Declaration of Eligibility and Liability/Publicity Release must be signed by his/her parent or legal guardian. If winner cannot be contacted, if prize is returned as undeliverable, or in the event of noncompliance with these Sweepstakes rules and requirements, the prize will be forfeited and an alternate winner will be selected. Upon prize forfeiture, no compensation will be given.
6. Conditions. All taxes are the sole responsibility of the winner. Participation in Sweepstakes and acceptance of prize constitutes winner's permission for Sponsor to use his/her name, address (city and state/province/territory), likeness, biographical information and any statements made by winner regarding the Sweepstakes or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. By participating, entrants, winner and travel companion agree to release and hold harmless Puerto Vallarta Tourism Board and Green Team Advertising, their respective advertising and promotion agencies, and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors, from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize or participation in any Sweepstakes-related activity and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Sponsor is not responsible if any prize cannot be awarded due to travel cancellations, delays or interruptions due to Acts of God, Acts of War, natural disasters, weather or terrorism. Entrants who do not comply with these Official Rules, or attempt to interfere with this Sweepstakes in any way shall be disqualified. Prize is non-transferable. No substitutions or cash redemptions. In the case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value. There is no purchase or sales presentation required to participate. A purchase does not increase odds of winning.
7. Additional Terms. Sponsor reserves the right, in its sole discretion, subject to the approval of the RACJ in Quebec, to cancel, terminate, modify, or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor will select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or Web site.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Use of Data. Sponsor will be collecting personal data about participants when they enter the Sweepstakes online. By participating in the Sweepstakes, entrants hereby agree to Sponsor's collection and usage of their personal information only for the purposes of contest administration unless they otherwise agree Participants also acknowledge that they have read and accepted Sponsor's privacy policy available at www.visitpuertovallarta.com.
9. For Quebec Residents. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
10. Winner. To obtain name of winner, send a self-addressed, stamped envelope by December15th 2008 to: Puerto Vallarta Sweepstakes, c/o Green Team Advertising: 286 5th avenue, 12th Floor, New York, NY 10001. Canadian residents may omit return postage.
